Welcome to NailMe. These Terms of Use ("Terms") govern your access to and use of the NailMe mobile application ("App"), provided by Qubin GmbH. By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Description of Service

NailMe is a beauty services marketplace platform that connects users with nail salons, artists, and beauty service providers. The App allows users to:

Browse and book nail and beauty services
View and share nail art designs and inspiration
Connect with beauty service providers
Manage bookings and appointments
Access premium features through subscription

Auto-Renewable Subscription Information

Premium Subscription: NailMe Premium

Subscription Tiers:

Seller Subscription: Enables professional account features for individual service providers
- Monthly plan: $9.99/month
- Auto-renews every month unless cancelled
Group Subscription: Enables salon/studio account features for businesses
- Monthly plan: $19.99/month
- Auto-renews every month unless cancelled

Payment: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage and cancel your subscriptions by going to your Apple ID account settings after purchase. Cancellation takes effect at the end of the current billing period.

Free Trial: If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.

Refunds: Refunds are handled according to Apple's App Store refund policy. Please contact Apple Support for refund requests.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account
Be at least 13 years old (or the minimum age in your jurisdiction)

4. User Content

4.1 Your Content

You retain ownership of content you post, upload, or share through the App ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App.

4.2 Content Standards

You agree that your User Content will not:

Violate any laws or regulations
Infringe on intellectual property rights
Contain harmful, threatening, or harassing material
Include spam or unauthorized commercial content
Contain malware or malicious code

5. Prohibited Activities

You agree not to:

Use the App for any illegal purpose
Impersonate any person or entity
Attempt to gain unauthorized access to the App or its systems
Interfere with or disrupt the App's functionality
Scrape, copy, or harvest data from the App without permission
Use automated systems (bots) to access the App
Post false, misleading, or fraudulent content

6. Service Provider Responsibilities

If you operate as a service provider on the platform, you additionally agree to:

Provide accurate information about your services
Honor bookings and appointments
Maintain professional standards
Comply with all applicable business licenses and regulations
Handle customer data in accordance with privacy laws

7. Bookings and Transactions

NailMe facilitates connections between users and service providers. The actual service agreement is between you and the service provider. We are not responsible for:

The quality of services provided
Cancellations or no-shows
Pricing disputes
Service provider conduct or qualifications

8. Intellectual Property

The App, including its design, features, text, graphics, logos, and software, is owned by Qubin GmbH and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Third-Party Services

The App may integrate with third-party services (Google Maps, payment processors, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

10. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

We may suspend or terminate your account and access to the App at any time, with or without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Harm to other users or the platform
Extended inactivity

You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted or error-free
Defects will be corrected
The App is free from viruses or harmful components
Results from using the App will meet your requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUBIN GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Qubin GmbH, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your User Content

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through:

Good faith negotiation between the parties
If negotiation fails, binding arbitration in accordance with German arbitration rules

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

17. Apple App Store Requirements

If you download the App from the Apple App Store, you acknowledge and agree that:

These Terms are between you and Qubin GmbH, not Apple
Apple has no obligation to provide support or maintenance for the App
Apple is not responsible for any product warranties
Apple is not responsible for addressing any claims relating to the App
Apple and its subsidiaries are third-party beneficiaries of these Terms

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Qubin GmbH regarding the App and supersede all prior agreements and understandings.
