Welcome to NailMe. These Terms of Use ("Terms") govern your access to and use of the NailMe mobile application ("App"), provided by Qubin GmbH. By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

NailMe is a beauty services marketplace platform that connects users with nail salons, artists, and beauty service providers. The App allows users to:

Subscription Tiers:

Payment: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage and cancel your subscriptions by going to your Apple ID account settings after purchase. Cancellation takes effect at the end of the current billing period.

Free Trial: If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.

Refunds: Refunds are handled according to Apple's App Store refund policy. Please contact Apple Support for refund requests.

The App may integrate with third-party services (Google Maps, payment processors, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

We may suspend or terminate your account and access to the App at any time, with or without notice, for:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUBIN GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

You agree to indemnify and hold harmless Qubin GmbH, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through:

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Qubin GmbH regarding the App and supersede all prior agreements and understandings.
